By accessing or using EmbedInsight ("the Service", "Platform", "we", "us", or "our"), you ("Customer", "you") agree to be bound by these Terms and Conditions ("Terms"). If you are entering into these Terms on behalf of an organisation, you represent that you have the authority to bind that organisation.
If you do not agree to these Terms, you must not use the Service. Continued use after any revision to these Terms constitutes acceptance of the revised Terms.
EmbedInsight provides a SaaS platform that enables organisations to embed Microsoft Power BI reports and analytics into white-label client portals. Features vary by subscription plan and may include, without limitation:
EmbedInsight is built on top of your existing Microsoft Power BI workspace. We do not provide a Power BI workspace, capacity, or license — those are your responsibility.
To access the Service you must create an account by providing accurate, complete, and current information. You are responsible for:
You must be at least 18 years old and legally capable of entering into contracts to use the Service. Accounts are non-transferable without our prior written consent.
EmbedInsight offers subscription plans billed on a monthly or annual basis. Payments are processed securely by Paddle, our authorised merchant of record. By subscribing, you authorise Paddle to charge the payment method on file at the then-current plan price on each renewal date.
Paddle as Merchant of Record. EmbedInsight's payment processing, invoicing, and tax compliance are handled by Paddle (paddle.com). When you purchase a subscription, your contractual relationship for the payment transaction is with Paddle. Paddle's own terms apply to the payment transaction.
You may cancel your subscription at any time from your account settings. Cancellation takes effect at the end of the current billing period — you retain access to the Service through the period you have already paid for.
Refund policy:
All refund requests are processed through Paddle. Refunds to credit or debit cards may take 5–10 business days to appear.
You agree not to use the Service to:
We reserve the right to suspend or terminate access immediately and without notice if we determine, in our sole discretion, that you have violated these restrictions.
Our property. EmbedInsight, its logo, the platform software, and all associated documentation are owned by or licensed to us and are protected by copyright, trademark, and other intellectual property laws. These Terms do not grant you any ownership interest in the Service.
Your property. You retain all rights to your data, Power BI reports, branding, and content that you upload or transmit through the Service. By using the Service, you grant us a limited, non-exclusive licence to process and display your content solely to provide the Service.
Feedback. Any suggestions or feedback you provide regarding the Service may be used by us without restriction or compensation to you.
Our collection and use of personal data is governed by our Privacy Policy, which is incorporated into these Terms by reference. Key points:
If you process personal data about individuals through the Service, you are the data controller and we act as a data processor. Please contact us if you require a Data Processing Agreement (DPA).
We aim to provide a reliable service but do not guarantee uninterrupted or error-free operation. The Service is provided "as is" and "as available". We may carry out scheduled maintenance (typically outside business hours, with advance notice where possible) and may experience unplanned outages.
Paid subscribers on Professional and Enterprise plans may request service credits where documented downtime exceeds 99% monthly availability, excluding:

Disclaimer of warranties. To the maximum extent permitted by applicable law, the Service is provided without warranties of any kind, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement.
Limitation of liability. To the maximum extent permitted by applicable law, EmbedInsight and its officers, employees, and affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or loss of profits, revenue, data, or goodwill, arising from your use of or inability to use the Service.
Our aggregate liability to you for any claim arising from these Terms or the Service shall not exceed the greater of (a) the total fees paid by you in the 12 months preceding the claim, or (b) USD 100.
Some jurisdictions do not allow exclusion or limitation of certain warranties or liabilities. In those jurisdictions, our liability is limited to the fullest extent permitted by law.
You agree to indemnify, defend, and hold harmless EmbedInsight and its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising from:

Upon termination, your right to use the Service ends. We will retain your data for a reasonable period (typically 30 days) to allow you to export it, after which it may be deleted. Sections covering intellectual property, liability, indemnification, and governing law survive termination.
We may update these Terms from time to time. Where changes are material, we will notify you by email or by posting a notice in the platform at least 14 days before the changes take effect. Your continued use of the Service after that date constitutes acceptance of the revised Terms.

These Terms are governed by and construed in accordance with the laws of the jurisdiction in which EmbedInsight is incorporated, without regard to conflict-of-law principles. Any dispute arising from these Terms shall be subject to the exclusive jurisdiction of the courts of that jurisdiction.
If you are a consumer in a jurisdiction with mandatory consumer protection laws, those laws may provide you with additional rights that these Terms do not override.
